Banking Law and Insolvency, Franchising Law

Our team of banking law professionals understands the needs of the financial services industry, the agro-food industry and the business community. We are always ready to provide creative and pragmatic solutions to our clients, in an effective and timely fashion. We also provide extensive expertise in bankruptcy and insolvency matters ranging from security enforcement to court-appointed receiverships and complex restructurings.

Our clients include major banks, credit unions, federally- and provincially-based lending institutions, federations, trustees, creditors, secured creditors and debtors. We have a particularly extensive client base among lending institutions present in the agriculture and agri-food sector.

We provide a wide range of services. We represent clients in matters arising under the Bankruptcy and Insolvency Act, Farm Debt Mediation Act and Companies’ Creditors Arrangement Act, as well as the Civil Code of Quebec. We are frequently called upon to appear before the courts in Quebec and to provide our expertise and effective negotiation skills in the context of mediation and other alternative modes of dispute resolution. Our professionals are frequent participants in industry conferences and publications.

We represent franchisors with respect to their franchising issues as well as any other legal needs they may have.

Our strength across various specialty areas sets us apart and allows us to anticipate and manage numerous issues related to insolvency, such as litigation, preferential payments, deemed trusts, contracts and financing agreements, all within the tight deadlines and timeframes that are particular to the field of bankruptcy and insolvency.

We can assist our clients in determining the best strategy and recourse in keeping with their business objectives and risk management goals. Our team instils confidence in our clients and we consider client service and support to be of foremost importance.
